The Fourth District Court of Appeals has recently held that caps on damages in claims for medical malpractice resulting in personal injury are unconstitutional. The caps imposed by the State Legislature many years ago severely limited victims’ access to the Courts and significantly capped the amount of compensation victims were allowed to obtain. The appellate court has now ruled that the caps are unconstitutional as violating the Equal Protection Clause of the State Constitution.
